Limitation of Authority of the BANI Arbitration Center in Government Construction Contract Disputes within the Electricity Sector

Pembangunan infrastruktur ketenagalistrikan merupakan sektor strategis nasional yang bersinggungan langsung dengan kedaulatan energi dan kepentingan publik. Oleh karena itu, sengketa kontrak konstruksi di dalamnya melibatkan irisan antara rezim hukum privat dan hukum publik. Penelitian ini bertujuan untuk menganalisis secara kritis dasar legitimasi serta limitasi kewenangan BANI dalam penyelesaian sengketa kontrak konstruksi pemerintah pada sektor ketenagalistrikan. Hal ini ditujukan guna menjamin perlindungan kedaulatan energi dan prinsip legalitas penyelenggaraan pemerintahan. Metode penelitian yang diterapkan adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus melalui teknik analisis silogisme deduktif yang bersifat preskriptif. Hasil penelitian menunjukkan bahwa legitimasi BANI bersifat derivatif dan terbatas. Lembaga arbitrase tidak memiliki otoritas adjudikatif untuk menguji keabsahan keputusan tata usaha negara yang bersifat administratif maupun mengesampingkan standar keselamatan ketenagalistrikan yang bersifat publik. Temuan ini menegaskan bahwa peran BANI wajib direkonstruksi agar tetap berada dalam koridor aspek komersial murni tanpa melampaui kewenangan administratif pejabat publik (ultra vires) dalam pengelolaan infrastruktur strategis nasional. Sebagai simpulan, limitasi kewenangan arbitrase merupakan manifestasi dari doktrin delegasi kewenangan terbatas yang diperlukan untuk menjaga akuntabilitas administrasi negara sekaligus memberikan kepastian hukum bagi investasi energi. Rekonstruksi ini memberikan kontribusi teoretis berupa integrasi harmonis antara otonomi para pihak dalam hukum perdata dengan kedaulatan hukum dalam ranah hukum tata negara dan hukum administrasi negara.
