Harmonization of Electricity Construction Claim Prevention Mechanisms: Integration of Pre-Construction Documents, FIDIC Standards, and Standing Dispute Boards

Sengketa konstruksi pada proyek strategis ketenagalistrikan nasional sering kali menghambat efisiensi biaya dan waktu. Masalah ini secara fundamental berakar pada ketidakpastian dokumen pra-konstruksi serta kesenjangan pengaturan antara kontrak nasional dengan standar internasional. Penelitian ini bertujuan untuk menganalisis implikasi yuridis ketidaklengkapan dokumen Persyaratan Pengguna Jasa terhadap validitas klaim. Penelitian ini juga mengevaluasi kesenjangan mekanisme notifikasi dan variasi pekerjaan antara standar kontrak BUMN dengan FIDIC Silver Book, serta mengkonstruksi model harmonisasi pencegahan sengketa. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, perbandingan, dan studi kasus pada proyek PLTA Asahan 3. Hasil penelitian menunjukkan bahwa sengketa di fase pelaksanaan merupakan residu dari kesalahan konsep desain di fase pra-konstruksi. Kondisi ini menciptakan asimetri informasi dan mencederai asas itikad baik. Analisis komparatif mengungkapkan kesenjangan signifikan pada prosedur variasi dan pembuktian. Kekakuan birokrasi kontrak nasional akibat disharmoni antara UU Nomor 2 Tahun 2017 dan rezim keuangan negara menghambat penyelesaian cepat dibandingkan mekanisme sistem peringatan dini FIDIC. Namun, bukti empiris menunjukkan bahwa aktivasi SDB mampu memitigasi eskalasi konflik secara efektif. Penelitian menyimpulkan bahwa model harmonisasi ideal harus mentransformasi paradigma dari penyelesaian sengketa menjadi pencegahan sengketa. Hal ini dicapai melalui integrasi pelembagaan SDB dengan validitas data digital BIM sebagai alat bukti utama yang tak terbantahkan. Langkah ini diperlukan guna menjamin kepastian hukum dan keberlangsungan proyek strategis nasional.
