Keberlanjutan Pembangunan Infrastruktur di Indonesia: Analisis Yuridis Penyesuaian Harga dalam Kontrak Konstruksi

Penelitian ini mengkaji mekanisme penyesuaian harga dalam kontrak konstruksi di Indonesia dari perspektif filosofis, yuridis, dan praktis. Latar belakang masalah ini berakar dari fluktuasi harga material konstruksi yang kerap mengancam keberlanjutan proyek infrastruktur. Untuk menjawab permasalahan tersebut, penelitian ini bertujuan untuk menganalisis landasan filosofis dan doktrin hukum yang mendasari mekanisme penyesuaian harga, mengevaluasi kerangka regulasi di Indonesia, serta merumuskan rekomendasi untuk meningkatkan efektivitas mekanisme pencegahan dan penyelesaian sengketa. Dengan menggunakan metode penelitian yuridis-normatif, penelitian ini menganalisis prinsip keadilan kontraktual dan doktrin rebus sic stantibus sebagai fondasi penyesuaian harga. Hasil penelitian menunjukkan bahwa UU Nomor 2 Tahun 2017, Peraturan Presiden Nomor 16 Tahun 2018, beserta peraturan pelaksanaannya telah mengatur mekanisme penyesuaian harga, namun implementasinya masih menghadapi kendala berupa kompleksitas administrasi dan biaya transaksi. Untuk meningkatkan efektivitas mekanisme tersebut, diperlukan standardisasi klausul penyesuaian harga yang mengacu pada best practices internasional, seperti standar kontrak FIDIC. Selain itu, optimalisasi sistem informasi harga berbasis teknologi digital dan penguatan kapasitas para pihak, serta pengembangan mekanisme penyelesaian sengketa yang efektif, khususnya melalui arbitrase, perlu dilakukan. Sebagai simpulan, penelitian ini menegaskan bahwa harmonisasi antara landasan filosofis, doktrin hukum, regulasi yang adaptif, serta mekanisme pencegahan dan penyelesaian sengketa yang efektif, menjadi kunci optimalisasi penyesuaian harga dalam kontrak konstruksi, guna mendukung iklim investasi dan pembangunan infrastruktur yang berkelanjutan di Indonesia.
