Integration of Anti-SLAPP in the Reform of the Indonesian Criminal Procedure Code in an Effort to Protect Human Rights

Partisipasi publik di Indonesia menghadapi ancaman kriminalisasi sistematis akibat kekosongan hukum prosedural dalam KUHAP. Celah ini memungkinkan penyalahgunaan proses hukum melalui SLAPP. Praktik ini membungkam suara kritis dan mendelegitimasi jaminan HAM dalam konstitusi. Penelitian ini bertujuan untuk menganalisis urgensi dan merumuskan kerangka normatif untuk mengintegrasikan mekanisme Anti-SLAPP secara komprehensif ke dalam RUU KUHAP. Dengan menggunakan pendekatan hukum normatif, penelitian ini mengkaji disharmoni antara norma perlindungan materiil dengan ketiadaan instrumen penegakan prosedural. Hasil analisis menunjukkan bahwa tanpa mekanisme penyaringan dini, aturan pergeseran beban pembuktian, dan pengakuan pembelaan berbasis kepentingan publik, KUHAP secara struktural gagal melindungi warga negara. Oleh karena itu, penelitian ini merekomendasikan integrasi mekanisme Anti-SLAPP yang inklusif dan non-sektoral ke dalam RUU KUHAP. Mekanisme ini tidak hanya melindungi aktivisme konvensional tetapi juga partisipasi di ruang digital. Langkah ini merupakan prasyarat fundamental untuk memperkuat supremasi hukum, mewujudkan komitmen SDG 16, dan memastikan resiliensi demokrasi Indonesia di masa depan.
