Ethics and Law of Personal Data Protection for Smartwatches in the Healthcare Sector

Pesatnya penggunaan smartwatch di sektor kesehatan menghadirkan dualisme fundamental antara potensi inovasi medis dan risiko sistemik terhadap hak privasi. Penelitian ini bertujuan untuk menganalisis secara kritis kesenjangan yuridis-etis antara praktik tata kelola data kesehatan oleh industri smartwatch dengan standar normatif yang diamanatkan oleh UU Nomor 27 Tahun 2022. Dengan menggunakan metode penelitian hukum normatif dan pendekatan analisis kesenjangan (gap analysis), penelitian ini membedah bagaimana praktik industri secara sistematis menciptakan defisit transparansi. Praktik tersebut juga mendevaluasi makna informed consent menjadi persetujuan ilusif. Hasil analisis menunjukkan adanya pertentangan diametral antara idealita regulasi (das sollen) yang mengedepankan otonomi pengguna dengan realita praktik industri (das sein) yang didorong oleh kepentingan komersial dan kepatuhan formalistik. Kesenjangan ini tidak hanya berimplikasi pada kerentanan pengguna terhadap eksploitasi data, tetapi juga pada tantangan efektivitas UU Nomor 27 Tahun 2022 dalam menjangkau kompleksitas teknologi wearable. Oleh karena itu, penelitian ini merekomendasikan pergeseran paradigma dari model berbasis persetujuan yang rapuh menuju model berbasis hak. Selain itu, penelitian ini mendesak adanya peraturan pelaksana yang spesifik untuk sektor teknologi kesehatan guna menjembatani kesenjangan yang ada dan membangun ekosistem digital yang adil dan akuntabel.
