Disparitas Penuntutan Tindak Pidana Kepabeanan: Studi Putusan Nomor 42/Pid.B/2024/PN Rhl dan Putusan Nomor 43/Pid.B/2024/PN Rhl

Penelitian ini bertujuan untuk menganalisis disparitas tuntutan tindak pidana kepabeanan dalam studi kasus Putusan Nomor 42/Pid.B/2024/PN Rhl dan Putusan Nomor 43/Pid.B/2024/PN Rhl. Penelitian hukum normatif ini menggunakan pendekatan tripartit, meliputi pendekatan perundang-undangan, pendekatan perbandingan hukum, dan pendekatan studi kasus. Analisis data menggunakan pendekatan analisis isi kualitatif untuk mendeskripsikan permasalahan dan menjawab tujuan penelitian. Hasil penelitian menunjukkan adanya disparitas yang signifikan dalam tuntutan antara kedua putusan, padahal kedua terdakwa terbukti secara bersama-sama melakukan perbuatan yang memenuhi unsur-unsur tindak pidana sebagaimana diatur dan diancam pidana dalam Pasal 102 huruf a UU Nomor 17 Tahun 2006 juncto Pasal 55 ayat (1) KUHP. Sebaliknya, Penuntut Umum mengajukan tuntutan yang berbeda secara substansial: pidana penjara dua tahun untuk satu terdakwa dan empat tahun untuk terdakwa lainnya. Disparitas dalam tuntutan yang mencapai dua kali lipat ini menimbulkan persoalan serius terkait proporsionalitas dan keadilan, melanggar prinsip persamaan di hadapan hukum, berdampak negatif pada kepastian hukum (rechtszekerheid), yang pada gilirannya dapat menggerus kepercayaan publik terhadap sistem peradilan dan menghambat penegakan hukum yang adil. Guna memitigasi disparitas dalam tuntutan, diperlukan upaya komprehensif dan sistemik, antara lain melalui pembentukan pedoman pemidanaan yang detail dan terstruktur, peningkatan kapasitas dan profesionalisme Penuntut Umum, penguatan mekanisme pengawasan dan evaluasi kinerja Penuntut Umum, serta penerapan sistem manajemen perkara yang efektif untuk mengidentifikasi potensi disparitas sejak awal.
