Petani Kelapa Sawit dalam Bahaya: Urgensi Indonesia dalam Membantu Petani Kecil untuk Bersaing Secara Adil di Lapangan

Penelitian ini dilakukan untuk mengungkapkan urgensi bagi Pemerintah Indonesia untuk mengadopsi peraturan mengenai perlindungan petani kelapa sawit. Adopsi ini diperlukan karena perjanjian kemitraan antara kelompok kecil ini dengan perusahaan non-kebun tidak efektif karena adanya benturan kepentingan antara Menteri Pertanian dan Menteri Perindustrian. Untuk mencapai tujuan tersebut, artikel ini ditulis berdasarkan penelitian doktrinal dengan mengumpulkan aturan-aturan dalam UU UMKM, UU Persaingan Usaha, UU Penanaman Modal, UU Cipta Kerja, dan SCM Agreement. Artikel ini juga didukung oleh teori keadilan dari Rawls. Pembahasan pertama dari artikel ini membahas mengenai urgensi untuk mengadopsi peraturan pemerintah ini berdasarkan UU UMKM dan UU Persaingan Usaha yaitu untuk menegakkan perjanjian kemitraan. Selanjutnya, pembahasan kedua menganalisis UU Penanaman Modal dan UU Cipta Kerja agar undang-undang yang dicita-citakan ini dapat menyeimbangkan hak dan kewajiban antara pekebun dan perusahaan perkebunan. Terakhir, pembahasan ketiga membahas apa yang harus diantisipasi sesuai dengan aturan WTO tentang subsidi. Sebagai penutup, artikel ini menyarankan penelitian selanjutnya untuk membahas pembagian kewenangan antara Kementan dan Kemenperin.
