Reformulasi Kebijakan Legalisasi Ganja untuk Kepentingan Medis: Tinjauan Hukum Pidana

Penelitian ini mengkaji urgensi reformulasi kebijakan legalisasi ganja di Indonesia, khususnya untuk tujuan medis, dari perspektif yuridis dan hukum pidana. Dengan menggunakan metodologi penelitian hukum normatif dan pendekatan tripartit yang meliputi analisis statutori, perbandingan hukum, dan studi kasus, penelitian ini menganalisis secara kritis kerangka hukum yang mengatur ganja di Indonesia dan posisinya dalam tren internasional. Temuan menunjukkan bahwa meskipun legalisasi ganja medis tengah berkembang pesat secara global, dengan dampak positif pada kesehatan pasien, kesehatan masyarakat, dan pembangunan ekonomi, pendekatan pengaturan di Indonesia masih terperosok dalam ambiguitas dan inkonsistensi. Disonansi ini muncul dari konflik antara ketentuan restriktif dalam UU Nomor 35 Tahun 2009 dan bukti ilmiah yang berkembang yang mendukung potensi terapeutik ganja dalam mengobati berbagai kondisi, termasuk gangguan spektrum autisme, epilepsi, sindrom Tourette, dan multiple sclerosis. Penelitian ini mengadvokasi kerangka kebijakan yang lebih manusiawi dan progresif yang selaras dengan kemajuan ilmiah dan memprioritaskan kesehatan masyarakat. Dua jalur utama reformulasi diusulkan: peninjauan kembali yudisial yang menantang konstitusionalitas undang-undang yang ada dan amandemen legislatif terhadap UU Nomor 35 Tahun 2009. Kunci dari setiap upaya reformulasi adalah landasan bukti ilmiah yang kuat serta pengembangan protokol pengaturan yang komprehensif dan kampanye edukasi publik untuk memastikan penggunaan ganja medis yang aman dan bertanggung jawab. Penelitian ini memberikan analisis kritis terhadap lanskap hukum dan kebijakan seputar ganja medis di Indonesia, menawarkan rekomendasi berbasis bukti untuk memandu para pembuat kebijakan menuju kerangka pengaturan yang lebih adil dan efektif.
