Hak atas Akses yang Adil terhadap Pendidikan Tinggi: Analisis Berdasarkan Falsafah Pancasila

Penelitian ini bertujuan untuk menganalisis secara komprehensif hak warga negara atas akses yang adil terhadap pendidikan tinggi di Indonesia berdasarkan falsafah Pancasila. Dengan menggunakan metodologi penelitian hukum normatif, penelitian ini mengkaji permasalahan melalui pendekatan perundang-undangan dan konseptual. Data dianalisis dengan teknik analisis isi kualitatif untuk mendeskripsikan dan menjawab permasalahan secara mendalam. Hasil penelitian menunjukkan bahwa akses yang adil terhadap pendidikan tinggi merupakan hak konstitusional setiap warga negara Indonesia yang dijamin oleh Pancasila dan UUD Tahun 1945. Sebagai perwujudan prinsip welfare state, negara berkewajiban untuk menciptakan sistem pendidikan tinggi yang berkeadilan, merata, berkualitas, dan terjangkau bagi seluruh lapisan masyarakat. Untuk itu, diperlukan regulasi yang afirmatif, skema pembiayaan yang inovatif dan berkeadilan, serta sistem penjaminan mutu yang andal. Pendidikan tinggi harus dipandang sebagai instrumen strategis untuk memutus mata rantai kemiskinan struktural, meningkatkan mobilitas sosial, dan mewujudkan keadilan distributif, dengan mengedepankan prinsip solidaritas sosial. Oleh karena itu, proyeksi menuju pendidikan tinggi gratis, khususnya di perguruan tinggi negeri, merupakan langkah strategis yang perlu diwujudkan secara bertahap dan berkelanjutan, didukung oleh reformasi sistem perpajakan yang progresif, peningkatan alokasi anggaran pendidikan, dan optimalisasi sumber pembiayaan alternatif sebagai bentuk tafsir progresif terhadap Pasal 31 ayat (1) UUD Tahun 1945.
