Kebijakan Daftar Negatif Investasi di Indonesia: Tinjauan Mengenai Perdagangan Bebas dan Konservasi Spesies Ikan yang Terancam Punah

Penelitian ini bertujuan untuk mengkaji dan menganalisis permasalahan yang timbul dari interaksi antara kebijakan investasi Indonesia dan kepatuhan terhadap rezim perdagangan internasional. Penelitian ini menggunakan metode penelitian hukum normatif. Bahan hukum yang terkumpul kemudian dianalisis secara kualitatif untuk mendeskripsikan masalah dan menjawab tujuan penelitian. Hasil penelitian menyimpulkan bahwa Indonesia telah berhasil menjustifikasi penyelarasan kebijakan Daftar Negatif Investasi mengenai spesies ikan yang terancam punah, yang tercantum dalam Appendix I CITES juncto Pasal XX GATT 1994. Di sisi lain, Dispute Settlement Body dapat mengeluarkan putusan dengan pertimbangan berbeda. Meskipun demikian, Perjanjian WTO dan CITES merupakan ketentuan yang dibuat untuk memberikan ruang negosiasi yang memadai bagi seluruh anggotanya. Dengan demikian, negara-negara anggota CITES dan WTO harus menahan diri untuk tidak menimbulkan sengketa mengenai kebijakan investasi Indonesia jika hal tersebut membatasi kepentingan ekonomi dan akses pasar mereka di Indonesia. Oleh karena itu, direkomendasikan agar anggota WTO dan CITES mengakui dan mengapresiasi kebijakan Daftar Negatif Investasi dalam menjaga keseimbangan antara pengembangan investasi dan perlindungan spesies ikan yang terancam punah. Lebih lanjut, para pemangku kepentingan didesak untuk mempelajari lebih dalam prinsip-prinsip dan tujuan Perjanjian WTO dan CITES. Selain itu, anggota organisasi terkait harus berkolaborasi dalam semangat solidaritas dan kesadaran lingkungan, mengutamakan dialog, konsultasi, dan negosiasi dibandingkan tindakan hukum sengketa yang dapat memperumit situasi. Dalam konteks ini, dialog multilateral dapat berfungsi sebagai platform yang efektif untuk memediasi beragam kepentingan dan mencari solusi berkelanjutan yang menguntungkan aspek ekonomi dan konservasi spesies ikan yang terancam punah.
