Kewenangan PPAT dalam Pembuatan AJB Terkait Tanah Warisan Milik Anak di Bawah Umur

Penelitian ini bertujuan untuk mengkaji dan menganalisis kewenangan PPAT dalam pembuatan AJB terkait tanah warisan milik anak di bawah umur dan mengidentifikasi faktor-faktor yang menghambat jual beli hak atas tanah warisan. Penelitian ini menggunakan metode penelitian normatif dan empiris, meliputi wawancara langsung dan studi literatur bahan hukum. Hasil menunjukkan bahwa PPAT akan melakukan pemeriksaan pendahuluan terhadap dokumen jual beli hak atas tanah untuk menghindari permasalahan yang timbul karena tidak terpenuhinya syarat materiil dan formil. Terkhusus, penjual harus melampirkan Putusan Pengadilan tentang wali yang sah, akta kematian pewaris, dan surat keterangan ahli waris untuk memenuhi syarat formil perbuatan hukum. Selanjutnya, faktor-faktor yang menghambat jual beli hak atas tanah warisan: ketersediaan dokumen, koordinasi antar pihak terkait, prosedur hukum dan birokrasi, serta faktor personal atau psikologis. Oleh karena itu, direkomendasikan agar PPAT, Pengadilan, dan pihak-pihak lain yang terlibat dalam proses jual beli hak atas tanah warisan secara aktif meningkatkan komunikasi dan koordinasi. Selain itu, perlu dilakukan penyederhanaan prosedur hukum dan birokrasi yang terkait dengan pembuatan AJB, termasuk pengurusan dokumen-dokumen yang diperlukan seperti Putusan Pengadilan tentang wali yang sah, akta kematian pewaris, dan surat keterangan ahli waris. Selanjutnya, diperlukan pelatihan dan penyuluhan hukum bagi PPAT dan pihak-pihak terkait untuk meningkatkan pemahaman tentang syarat-syarat materiil dan formil yang harus dipenuhi dalam perbuatan hukum jual beli hak atas tanah warisan.
